We are a small wholesaler in Florida and supply a few LFS in Utah. We received an order from one of them at the beginning of August. We packed the order and tried to charge his credit card, but it declined. I called the customer and he assured me that it was going to be fine the next morning, so we shipped 7 cartons of fish, inverts and some very nice Australian Corals to him on August 2.
His Credit Card continued to decline and we had no return calls, emails or any other form of communication with him. On August 6, he finally called and told me that the airline lost the shipment in Chicago and when he got it, a lot of the stuff was dead. So I offered to file a claim with the airline. For some reason, our driver marked the value of the shipment at $ 500.00 instead of the $ 1200.00 that it was worth and the customer got very upset over this. So, I offered to replace all the DOA stuff in a new shipment and the customer agreed. Meanwhile I had not received a payment for anything.
After that, I might have had 2 more conversations with this customer trying to get paid, which he promised to do, and trying to schedule the replacement shipment. After that, he stopped returning my calls and emails.
I filed a claim with the airline, just to find out that the customer had done the same. The airlines policy is to pay claims to whoever pays the shipping and the customer got a check for $ 631.45. For a shipment that he never paid for in the first place!
In addition to that, he was advertising the corals I sent him on his website! I have screenshots of it.
I am very disappointed over the business practices this individual displayed. I have tried to contact him frequently but have not received any communication back.
I am now in contact with the Utah State Attorney, they are looking into the matter for me.
Sorry for the rant but you guys need to know what’s going on in your State, if he rips off vendors, he might do it with customers too?

Sounds very familiar, people on this state are having problems with this person that has taken money but not given their products they pay for, i dont know if they are the same person

Interesting read...but trying to understand the purpose of the post? Unless we are told who this person/company/distributor is, then how is this helpful to us?

So he did recieve this shipment that he never paid for and then advertised and sold them? And then on top of that, recieved a $631 check from the airline? Did he cash it? Wow! Airlines are something I would never try to pull a fast one on. Im no attorney but I think thats a federal offense, and if this is true, this guy is facing very serious fraud charges punishable by huge fines, restitition, and if convicted, I wouldnt be at all suprised to see him going to jail. I hope not, but all I can say is wow....

Exsea,
I'm very sorry that you had such a negative experience here in Utah. Please understand this is an isolated incident and not all the stores around here are that dishonest... Hopefully it hasn't discouraged you from doing buisness here. Furthermore good luck in going after him.

I stated the facts exactly as they happened. True is that the shipment got "misplaced" in Chicago for about 24 hours. According to SWA tracking it then arrived in Salt Lake at 11.10am but was not picked up until 11.46 pm. Again, I had no knowledge of this until that Friday. It took another 5 days until he send me some pictures of bags with DOA items. Where they from the shipment? I don't know. We ship to Europe and Asia and our shipments are sometimes over 48 hours in transit without DOA's.....He also acknowledged that not everything was dead. What he was very upset over was that the declared value on the AWB was wrong. I felt bad for him at the time even though we are not responsible for airline delays and offered him a replacement shipment. There where two more email conversations after that and then the communication stopped, he never replied to any calls or emails.
I have a letter from SWA that confirmed that he got the reiumbursement for the declared value and the freight.
So had we put the correct value on the AWB, he would have pocketed $ 1200.00 plus freight.

I hear ya and all the other stores I deal with are great! Times have been tough and sometimes unforseen things do happen. But all can usually be worked out. I still had hope that it wouldn't have to come to this. After reading the other thread, I am not surprised anymore.

Being involved in the other thread, I'm not very surprised either. I had heard a few bits of information that led me to believe this might be the case, now it seems to be confirmed. How could this LFS owner have thought that all this would not catch up with him. It's one thing to steal from customers and small suppliers, but to make fraudulent claims with an airline, that employs lawyers to go after people like this, that's the only surprising part.

I am glad you posted exsea.
After today's debacle with this guy, I'm even more fed up than before!
My $50 doesn't warrant small claims court in my opinion but I will gladly jump in on any other cases with my testimony and add my story to the report.
I am sorry for what has happened with you Exsea. I know other businesses you deal with and they are stand up people. I won't deal with anyone else in this state anymore after this whole mess. I will stick to the true and honest people that I have built a relationship with over the years.

Ryan, it is sad that things like that always leave a bad taste in your mouth. But please, do support the local businesses that are honest and employ ethical business practices.
I also posted in the other Utah forum and got a reply from an attorney that is ready to help us. And I am sure the State Attorney will be interested to hear other victims testimony.
And if we cannot get financial satisfaction, I strongly believe in Karma.......

Karma or not, I think he's going to have a hard time selling over here after everything that's happened.
Exsea, I'm sorry about this mess he's gotten you into. I hope everything goes well and you're able to get back what you're owed. And there's no need to apologize for the rant, as you've seen, you're not the only on that's a little upset about this.
